Use of the website

You agree to use the Site only for lawful purposes and in a way that does not infringe the rights of, or restrict or inhibit the use of, the Site by others. You agree not to attempt to gain unauthorized access to the Site, interfere with its operation, submit malicious code, or use automated means to abuse our forms.

Contact and project requests

The Site allows you to submit contact and project requests. Submitting a request does not create a contract, project, or any obligation for PG Works Online to provide services. Any engagement, scope, pricing, and timeline are confirmed separately in writing. Information you provide should be accurate, and you are responsible for the content you submit.

No guaranteed availability

We do not guarantee that any particular service, project slot, timeline, or pricing is or will remain available. Availability, scope, and rates may change at any time, and certain features (such as quote or booking requests) may be limited, disabled, or unavailable without notice.

Client agreements

If you become a client, the scope, pricing, and terms of any engagement are governed by your separate written service agreement—not by this website. For questions about an existing agreement, contact us using the details at the end of these Terms.

Intellectual property

The Site, including its text, design, graphics, logos, and other content created by PG Works Online, is owned by or licensed to PG Works Online and is protected by applicable intellectual property laws. You may not copy, reproduce, or redistribute Site content without permission, except as allowed by law. Ownership of deliverables created for clients is addressed in the applicable service agreement.

Third-party services

The Site relies on and links to third-party services, including Cloudflare (bot protection), Resend (email delivery), our hosting and analytics provider, and our content platform. Your use of those services may be subject to their own terms and privacy policies. We are not responsible for third-party services or websites that we do not control.

Content accuracy and “as is” disclaimer

We work to keep the information on the Site accurate and current, but we do not warrant that it is complete, accurate, reliable, or error-free. Content may be updated or changed at any time without notice. The Site and its content are provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, to the fullest extent permitted by law.

Limitation of liability

To the fullest extent permitted by law, PG Works Online LLC, its members, and personnel will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from or related to your use of (or inability to use) the Site. Nothing in these Terms limits liability that cannot be limited under applicable law.

Indemnification

You agree to indemnify and hold harmless PG Works Online LLC, its members, and personnel from claims, damages, and expenses arising out of your misuse of the Site or your violation of these Terms.

Governing law and venue

These Terms are governed by the laws of the State of Colorado, USA, where PG Works Online LLC is organized, without regard to its conflict-of-laws rules. To the extent permitted by applicable law, you agree that the exclusive venue and jurisdiction for any dispute arising out of or relating to these Terms or the Site will be the state and federal courts located in Colorado, and you consent to the personal jurisdiction of those courts. Nothing in this section limits any non-waivable rights you may have under the laws of your place of residence.

We may update these Terms from time to time. Changes are effective when posted, and the “Last updated” date above will reflect the most recent revision. Your continued use of the Site means you accept the updated Terms.
